The Law Commission, led by Chairman Justice AP Shah has recommended the abolition of death penalty, but except in terror related cases. Principle of ‘rarest of rare’ cannot be operated free of arbitrariness, says the Law Commission. However, the Commission excluded all cases related to terrorism and waging war against India from the exemption.
